What you agree to, and what we are responsible for.
Decknative sends email from your own mailbox, as you. That single fact determines most of what follows — you are the sender, you own the relationship with the people you contact, and you carry the legal responsibility that comes with it. These terms say exactly where our responsibility begins and ends.
Who these terms are between
These terms govern your use of Decknative, a self-serve outbound email platform operated by Marouan Doulahiane, registered at Hey Tagot Kasbat Taher Block 8, Agadir 80000, Morocco. By creating an account you agree to them. If you do not agree, do not use the service.
Questions about these terms: hello@decknative.com.
What the service does
Decknative helps you import a list of contacts you already have, define who you are trying to reach, generate draft emails with AI assistance, review every draft yourself, and send those emails through a mailbox you connect and control.
We do not supply contact lists, email addresses, or contact data of any kind. You bring your own list. We do not source, buy, scrape or enrich leads on your behalf.
You are the sender
This is the most important clause here. Email sent through Decknative leaves your own mailbox, from your own address, on your own domain. To every recipient, and in law, you are the sender. We are the tool you used.
That means you are responsible for the content of every message, for having a lawful basis to contact each recipient, and for complying with the law that applies to you and to them — including CAN-SPAM in the United States, the GDPR and ePrivacy rules in the EU and UK, PECR in the UK, CASL in Canada, and Law 09-08 in Morocco.
You are responsible for honouring opt-outs and for not contacting anyone who has asked you not to. The product helps: every message carries a working unsubscribe link and one-click unsubscribe headers, a physical postal address is required before a campaign can send, and a lead is removed from further contact when they reply or unsubscribe. Those are safeguards, not a transfer of responsibility.
Do not use Decknative to send unlawful, deceptive, harassing or misleading email, to impersonate anyone, or to contact people you have no lawful basis to contact.
Your mailbox and the access you grant
To send, you connect a mailbox using your provider’s own OAuth flow — Microsoft 365 today, Google when our verification with Google completes.
We request permission to SEND ONLY. From Microsoft that is the delegated Mail.Send permission; from Google it is the gmail.send scope. Neither grants the ability to read your inbox, and we do not request any scope that would. We do not read, index, store or analyse the contents of your mailbox.
Your access tokens are encrypted at rest. You can disconnect a mailbox at any time from the app, or revoke our access directly with Microsoft or Google, which takes effect immediately.
Sending is subject to per-mailbox daily limits and to the send window you configure. These exist to protect your own domain reputation and are not adjustable beyond the published plan limits.
Replies
Outgoing messages carry a Reply-To address on a domain we operate, so that a reply can be matched to the campaign that prompted it and that person can be removed from further contact automatically.
We receive those replies in order to do that. We do not read the mailbox you connected — the reply arrives at our address because your message asked it to. Reply content is stored so you can read and act on it in the app.
Plans, credits and payment
Paid plans are billed monthly in advance. Payments are processed by Whop, which acts as merchant of record and is responsible for collecting and remitting applicable VAT and sales tax. We never see or store your card details.
A credit is consumed when a lead is scored, drafted and successfully sent. If a send fails, no credit is consumed. Replies, reply classification and use of the dashboard are free.
Credits are allocated per billing period and are not redeemable for cash. When your balance reaches zero, campaigns pause rather than sending without a credit.
You can cancel at any time and keep access until the end of the period you have paid for. We do not pro-rate partial periods.
Your data
The contacts you import, the campaigns you create and the messages you send are yours. We process them to provide the service and for no other purpose. We do not sell them, and we do not use one customer’s data to serve another.
Draft generation uses a third-party AI provider. Message drafts and the context needed to write them are sent to that provider for processing. We do not permit that data to be used to train their models.
You can export or delete your data at any time. Deleting your account deletes your contacts, campaigns and messages.
How personal data is handled in more detail, including your rights, is set out in the privacy notice.
Acceptable use
You may not use Decknative to send unsolicited email in jurisdictions where doing so is unlawful, to send malware or phishing, to evade spam filters or authentication, to send on behalf of a third party without their authority, or to attempt to circumvent the sending limits in the product.
You may not resell access, share credentials, or use the service to build a competing product.
We may suspend an account that is causing harm to recipients, to other customers, or to the deliverability of the platform. Where circumstances allow, we will tell you why and give you the opportunity to fix it first.
Availability and what we do not promise
We do not guarantee that any email will be delivered, will reach an inbox rather than a spam folder, or will receive a reply. Deliverability depends on your domain, your mailbox provider, your list quality and your content — most of which are yours, not ours.
The service is provided as-is. We do not warrant that it will be uninterrupted or error-free.
To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for lost profits, lost business, or damage to your domain or sender reputation.
Nothing here limits liability that cannot lawfully be limited.
Ending the agreement
You can stop using the service and close your account at any time.
We may end this agreement if you materially breach these terms, with notice where circumstances allow.
Because you connect your own mailbox and your own domain, ending this agreement does not take your sending infrastructure with it. Your mailboxes, domains and contact lists remain yours and continue to work without us.
Changes and governing law
We may update these terms. If a change materially affects your rights we will tell you before it takes effect, and continued use after that constitutes acceptance.
These terms are governed by the laws of Morocco, and the courts of Morocco have jurisdiction, except where consumer protection law in your own country gives you the right to bring a claim locally.
